These Terms of Service (“Terms”) govern your access to and use of atlantahoaservices.com (the “Site”), operated by ATL HOA Services LLC (“AHS,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About our services
AHS provides HOA vendor oversight and contractor management services to community associations in Metro Atlanta, including oversight of landscaping, pest control, pool service, and preventative maintenance vendors. AHS acts as an owner-side oversight and coordination partner. We do not perform community association management, structural engineering, regulated inspections, legal, or accounting services ourselves; where such services are needed, we coordinate qualified licensed professionals on a client’s behalf under a separate written agreement.
The content on the Site is provided for general informational purposes only. It describes our services in general terms and does not constitute an offer, a guarantee of results, or professional, legal, or financial advice.
2. No service agreement formed through the Site
Submitting a contact form, quote request, or assessment (audit) request through the Site does not create a client relationship or a binding agreement for services. Any engagement for services is governed by a separate written agreement between you (or your association) and AHS.
3. Eligibility and acceptable use
You must be at least 18 years old and able to enter into a binding agreement to use the Site. You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Submit false, misleading, or fraudulent information;
- Attempt to gain unauthorized access to the Site or its systems;
- Interfere with or disrupt the Site, its servers, or networks; or
- Copy, scrape, or harvest content or data from the Site without our written permission.
4. Intellectual property
The Site and its content (including text, graphics, logos, design, and the AHS and CAP names and marks) are owned by or licensed to AHS and are protected by intellectual-property laws. You may view and use the Site for your personal, non-commercial, informational purposes. You may not reproduce, distribute, modify, or create derivative works from the Site’s content without our prior written consent.
5. Information you submit
You are responsible for the accuracy of information you submit through the Site. By submitting information, you grant AHS permission to use it to respond to your request and as described in our Privacy Policy.
6. Third-party links
The Site may link to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of those third parties, and including a link does not imply our endorsement.
7. Disclaimers
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on the Site is complete, accurate, or current.
8. Limitation of liability
To the fullest extent permitted by law, AHS and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the Site. To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US $100). This section does not limit liability that cannot be limited under applicable law.
9. Indemnification
You agree to indemnify and hold harmless AHS and its members, managers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or your violation of these Terms.
10. Governing law and venue
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in DeKalb County, Georgia, and you consent to the personal jurisdiction of those courts.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
